Within Germany it's allowed to attach the bill for the lawyer's time to it (usually a few hundred EUR), so of course this became an industry of its own, especially regarding file sharing. Jochen once got one of these because he wrote "insured delivery" in his eBay auctions. Apparently this is admonishable because as a trader the delivery risk is always his, so advertising that his packages are insured is an illegal competitive advantage. Bloody ridiculous.

I've had some crap over the years from my fellow German countrypeople! I once sold a car on eBay but the buyer didn't react for 5 days so I offered it to the 2nd place person, who agreed to the offer. Then the first person responded and still wanted it (and actually collected it) so I explained to the 2nd person that it was already sold and what had happened, expecting the British-type response that I would have given had it been the other way round, along the lines of 'OK mate, thanks for letting me know. These things happen'. But no, they actually tried to take legal action against me, demanding that I sold them the same car that I'd already sold and expecting hefty financial damages if I was not willing or able to sell it to them. Welcome to Germany! That's how a lot of people seem to roll here. Petty.

Ask me about felt pads - I can cut them to size and they have proved excellent for mdv data recovery.

The software in question is at https://www.synaxus.de/index.php/en/traceminer/tm-40 and the company is Synaxus. They apparently registered the Trade Mark "TraceMiner" back in 2013.

If they are looking to take money off me for "legal costs" they can go seduce themselves! IN my world, you contact people with your grievances first, then go legal if/when you get no response. Last night was the first I've heard of them and from them.

The lawyers in question specialise in Trade Marks. They are at https://www.wuesthoff.de/en/.

Cheers,
Norm.

From what I understand, trade mark holders are required to defend their marks legally or risk losing them, so that was the only way they can play it officially. This is unlike other types of "intellectual property".

Having said this a lot of the time it's bullying, especially if you're not operating in the same area of business and there's no way that people can mistake one mark for the other. Trade marks include the way the brand looks, including colours and typeface. i.e. it's a BRAND mark. However, it takes a lot of money to defend against these bullies.

I note that they use almost exclusively "SYNAXUS TraceMiner" in their documentation, so it could be argued that without "SYNAXUS" it wouldn't be mistaken for their product.

But it provides a similar function and would reasonably be found by people searching for the TM'd product, so it meets the definition of "confusingly similar."

...the final piece of this little beauty:

Case is in good shape and though I ordered top and bottom separately (likely adding about $10 to the order in shipping) the two pieces seem to match up. The bottom has the slightest of slight warps to it. It's the UK version and has 6 feet holes.

I may next order one of the keys from SellMyRetro just to see if I can create a 3-D model and print all of them. Anyone done that already?

Initially I got the bottom piece to see how the Q68 would fit but then I got excited about mold making so that's why I got the top piece. Will try and create molds of each over the summer. Anyone want a yellow QL?

I seem to recall that someone on the forum (vanpeebles?) has an albino-white QL :ugeek:

Is it painted or did you make the mold for it? I do recall seeing a picture of it.

I found a picture of it...I did remember stumbling over it and going "wow" when I saw it.

If I'm successful you can let me know if you want a pure white one molded. I'm doing it for fun so it would just be cost of material and shipping so not too expensive...
